Welcome to Rebyrth. These Terms of Service ("Terms") govern your access to and use of the Rebyrth platform, website, and services (collectively, the "Service"). By accessing or using Rebyrth, you agree to be bound by these Terms.

Acceptance of Terms

By creating an account, accessing, or using Rebyrth, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

Description of Service

Rebyrth is a platform designed to support individuals and families throughout their journey to parenthood. We provide access to resources, consultations, and support services. The Service may be modified, updated, or discontinued at any time at our discretion.

User Accounts

To use certain features of Rebyrth, you must create an account.

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws.
• Transmit any harmful, offensive, or inappropriate content through the Service.
• Attempt to gain unauthorized access to the Service or its related systems.
• Interfere with or disrupt the Service or servers connected to the Service.
• Use automated systems or bots to access the Service without permission.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

Important: Rebyrth is not a substitute for professional medical advice, diagnosis, or treatment. The information and services provided through Rebyrth are for informational and support purposes only. Consultations and Services

Rebyrth may facilitate consultations with healthcare providers or support professionals. These consultations are subject to separate agreements and terms between you and the service provider. Rebyrth acts as a platform facilitator and is not responsible for the quality, accuracy, or outcomes of any consultations or services provided by third parties.

Text Messaging (SMS) Program Terms

These terms govern the Rebyrth Care Updates text messaging program (the "Program"). By opting in you agree to them in addition to the rest of these Terms.

Program description

The Program sends recurring text messages from (757) 272-1049 to subscribers who have opted in. Messages include:

• appointment and home-visit confirmations, reminders and schedule changes
• class and group-session announcements for your region
• replies from your Rebyrth support team about your care

Rebyrth does not send marketing or promotional text messages through this Program.

How to join

You can opt in by entering your mobile number and checking the consent box at /sms-opt-in, by texting START to (757) 272-1049, or by giving verbal consent to a Rebyrth staff member during an appointment or intake call. Consent is not a condition of purchase and is not required to receive care or any other Rebyrth service. You must be the subscriber of, or the customary user of, the mobile number you provide, and you must be at least 18 years old.

Message frequency and cost

Message frequency varies based on your care plan and appointments. Message and data rates may apply. Your mobile carrier may charge you for each message sent or received according to your plan; Rebyrth does not charge for the Program itself. Contact your carrier for details of your plan.

How to cancel — STOP

You can cancel at any time by replying STOP to any message from the Program. You may also text STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT. After you send one of these, we will send a single message confirming that you have been unsubscribed, and you will receive no further messages from the Program. To rejoin, sign up again at /sms-opt-in or reply START.

How to get help — HELP

For help, reply HELP to any message from the Program, email support@rebyrth.com, or call (757) 272-1049.

Supported carriers and delivery

The Program is available on most major U.S. mobile carriers. Carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier and network conditions, and Rebyrth cannot guarantee that any individual message will be delivered. Do not rely on text messaging for urgent or emergency matters — in a medical emergency, call your local emergency services immediately.

Your information

Information we collect through the Program is handled as described in our Privacy Policy. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. Your consent and opt-in information cannot be shared with, sold to, or bought by third parties or affiliates. Your consent to the Program is given directly to Rebyrth.

Changing your number

If you change or give up your mobile number, please tell us at support@rebyrth.com so that we do not text a number that no longer belongs to you.

Intellectual Property

The Service, including its original content, features, and functionality, is owned by Rebyrth and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content from the Service without our express written permission.

User Content

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant Rebyrth a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such User Content solely for the purpose of providing and improving the Service.

You are solely responsible for your User Content and represent that you have all necessary rights to grant the license described above.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us or using the account deletion features available in the Service.

Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. REBYRTH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REBYRTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify, defend, and hold harmless Rebyrth, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service, your User Content, or your violation of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Rebyrth operates, without regard to its conflict of law provisions.
